Terms and privacy

FashionPix is a trade name of NovaVenture, a Dutch company registered at Hector Treubstraat 61, 1782 HD Den Helder, the Netherlands. Chamber of Commerce (KvK) number 91981549, VAT number NL004929279B94.

• FashionPix — the platform that creates product photos, videos and product texts.
• User — the natural or legal person holding an account. Below: you.
• Credits — the unit in which you pay for a shoot.
• Shoot — the result per item: images, optionally a video, and texts.
• Brand profile — your chosen faces, light and framing, so every next shoot gets the same style.

They apply to every agreement between you and us. By creating an account, installing the FashionPix app in your Shopify store, or making a payment, you accept them. If you use FashionPix on behalf of a company, you declare that you are authorised to do so.

From your product photo the platform creates: on-model images, a packshot on white, detail shots, optionally a short video, and the texts that go with them — meta title, meta description, a short and a long product text, alt texts and size information, in four languages (Dutch, German, English, French).

Exactly what a set contains is shown before you click "Make my set", with the number of credits next to it. We may change the composition of the offer; what you have already ordered does not change because of that.

Prices are in euros and exclude 21% VAT. On fashionpix.nl you pay through Mollie (iDEAL, credit card, bank transfer) and receive a VAT-compliant invoice automatically. Business customers within the EU with a valid VAT number can use the reverse-charge mechanism.

Installed from the Shopify App Store

If you installed FashionPix from the Shopify App Store, all charges run through Shopify Billing: the subscription and any credit purchases appear on your Shopify invoice, and you approve every charge inside Shopify before it is made. You can change or cancel your plan from the app in your Shopify admin at any time; uninstalling the app ends the subscription.

Credits

Credits from a monthly subscription do not expire and accumulate. One-off packages do not expire either.

Failed images cost nothing

If no usable image comes out, we automatically refund the credits. You do not pay for failures. That is not goodwill but how the system works: billing is per image, and an image that is not delivered is not charged.

Cancelling

You cancel a monthly subscription in your account settings (or, for App Store installs, in the app inside Shopify). You keep access and your credits until the end of the period you have already paid for.

All images, videos and texts generated by FashionPix are your property as soon as the shoot is completed. You receive a full commercial licence, worldwide and perpetual, without additional licence fees.

The models in your images are generated persons. There is no model contract, no expiring usage right and no additional payment for reuse.

The images are machine-generated. Since 2 August 2026, Article 50 of the European AI Act is enforceable: whoever creates such material must mark it in a machine-readable way.

We do that automatically. Every file you receive from us carries its provenance in the file metadata (IPTC digitalSourceType via XMP and EXIF):

• an image in which your garment has been placed on a generated model is marked as generated material;
• a packshot or crop — where only the background has been removed — is marked as edited material. A real photo with the background removed is an edit, not an invention.

A ghost-mannequin shot shows no person and therefore does not fall under the disclosure duty for deepfakes. If you choose that route, a visible AI notice next to your product is not required.

Your side: where the regulation requires a visible notice to the visitor, you as the shop operator are the one who places that notice. We provide the marking and the information; we cannot see whether and how you publish the images. The implementing rules of the regulation are still being refined — we will adjust our marking if that becomes necessary.

• You have the right to use the photos and products you upload.
• You do not infringe the rights of others — trademarks, copyright, portrait rights.
• You use the result in accordance with applicable law, including the disclosure duty above.
• You do not upload material showing identifiable persons without their consent.

We aim for the highest achievable quality and check every image automatically. Images that do not pass that check are remade at no cost.

FashionPix's liability is limited to the amount you paid in the twelve months preceding the event causing the damage. We are not liable for indirect damage, lost profit or consequential damage.

In case of serious abuse — fraud, infringement of third-party rights, illegal content — we may terminate an account immediately, without warning. You can have your own account deleted at any time; send a message to info@fashionpix.nl. Uninstalling the Shopify app removes the link between your store and FashionPix; the account itself stays until you ask us to delete it.

Dutch law applies to this agreement. Disputes are submitted to the competent Dutch court. This English text is a translation of the Dutch Voorwaarden en privacy; in case of any discrepancy, the Dutch version prevails.

NovaVenture (KvK 91981549) is the data controller for the personal data processed through FashionPix. Questions about your data go to info@fashionpix.nl.

Account data

Name, e-mail address, company name and VAT number if provided, and your password in encrypted form.

Payment data

Card numbers and bank account numbers are processed exclusively by our payment partner Mollie — or, for App Store installs, by Shopify. FashionPix itself does not store any payment data. We only see whether a payment succeeded and what amount it concerned.

Your Shopify store (App Store installs)

When you install the app we receive an access token limited to reading and writing products (read_products, write_products) plus the store's name, e-mail address, domain, currency, country and plan. We read your product titles, handles and images to find items without a model photo, and we write the finished images and texts back to the products you choose. We do not read orders, customers or payment information. Shopify's mandatory privacy webhooks (customers/data_request, customers/redact, shop/redact) are handled: we hold no customer data of your buyers, and on shop/redact we delete the store record, its access token and the scan results.

What you upload

The photos of your products and the scanned labels. We do not use them to train models. They are sent to the processors listed in the next article, because without that step no image comes out.

Usage data

Which features are used and how often, to improve the platform and to trace errors. There are no third-party trackers on the site and no advertising pixel.

• Providing the service: creating shoots, delivering, invoicing.
• Contact about your account: questions, outages, changes.
• Legal obligations: tax administration, fraud prevention.
• Improving the product, based on anonymised figures.

We do not sell data and share nothing for commercial purposes. To provide the service we use these processors:

Some of these parties are located in the United States. Transfers there take place on the basis of the EU–US adequacy decision (Data Privacy Framework) and, where that does not apply, on the basis of the European Commission's standard contractual clauses.

• Account data — until you have your account deleted, plus 30 days in backups.
• Invoices and bookkeeping — 7 years. That is a statutory retention period we cannot deviate from.
• What you upload and what we create — until you delete it or your account is deleted. We do not clean up automatically: your shoots stay until you do something with them yourself.
• Shopify store record — until you uninstall the app; the access token is invalidated at once and the record is deleted when Shopify sends shop/redact (48 hours after uninstall).

Under the GDPR you have the right to:

• access your data;
• have inaccuracies corrected;
• have your account and data deleted;
• object to certain processing;
• receive your data in a portable form;
• lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

All traffic runs over TLS. Passwords are stored encrypted and are not readable by us. Access to the database is limited to those who need it, with per-user access rules (row level security), so that one account can never reach another's data.

Which cookies there are — and why there are few — is set out in the cookie statement (Dutch). If you process data of your own customers through FashionPix, a data processing agreement (Dutch) applies; it is in place and applies automatically to business customers.

We may change these terms and this policy. For important changes we give at least 30 days' notice by e-mail or through a notice in the app. The date at the top of this page states when something was last changed.
